Two teens face attempted murder charge

MENOMINEE — Two Wisconsin teens face attempted murder charges following a drug deal gone wrong in Menominee last December.

Logan Daniel Race, 17 of Oconto Falls, Wis., was arraigned Wednesday following his recent waiver of extradition from the State of Wisconsin. Menominee County Prosecuting Attorney Jeffrey T. Rogg previously charged Race in a two-count felony complaint alleging Assault with Intent to Commit Murder and Felony Firearm.

According to a press release from the Menominee County Prosecutor’s Office, Rogg also charged Moxie J. Bartke of Lena, Wis. — who is now 15 but was 14 at the time of the incident — as an adult under Michigan’s “automatic waiver” statute, in a separate felony complaint with charges identical to those faced by Race. The automatic waiver process allows prosecutors to elect “waive” certain juvenile offenders into the circuit court to be tried as adults for certain specified juvenile violations, including Assault With Intent to Commit Murder.

The charges against both defendants stem from an incident that occurred on Dec. 28, 2020, at approximately 12:10 a.m., when the Menominee Police Department received a 911 call to 1315 30th Ave. in Menominee for a complaint of “shots fired” and a report that a subject at the residence was shot. Sgt. Andrew Bunch responded to that address, where the victim reported that he was shot by a person known to him as Race, who was at the home with Bartke.

According to a press release issued by the Menominee Police Department in December, the shooting took place during an illegal narcotics transaction.

The victim told police during the initial investigation that the suspects fled his residence on foot after the shooting. Neither suspect was present when police and EMS arrived at the scene, but were apprehended later in Oconto, Wis.

The victim was taken to Aurora Medical Center Bay area to receive treatment for the non-life threatening gunshot wound he sustained in the shooting. He is recovering from his injuries.

Wednesday, Circuit Court Judge Robert J. Jamo appointed attorney Joseph J. Klumb, of Menominee, to represent Race and scheduled a probable cause conference for Feb. 12 at 1:45 p.m. The preliminary examination was also scheduled for Feb. 18 at 1:30 p.m.

Bond for Race was set at $500,000, cash only.

Bartke is being held in Wisconsin and his extradition proceeding is pending.

During the initial incident, the Menominee Police Department was assisted by Michigan State Police, Menominee County Sheriffs Office, Marinette City Police Department, the Oconto Police Department, Menominee Fire Department, and the Aurora Medical Center Bay Area EMS.
