Two enter plea agreements in sexual assault cases

ESCANABA — Two defendants facing criminal sexual conduct charges took plea agreements during a hearing in Delta County Circuit Court Tuesday. By entering pleas, the two defendants have been scheduled for sentencing and their upcoming trials were canceled.

“The trial scheduled to begin on Monday, the jury can be called off in its entirety. And then with regard to the trial scheduled for October, we’ll only need one jury instead of two,” Dickinson County Circuit Court Judge Mary Barglind said.

Hunter Grizz Gallagher, 18, of Gladstone, and Dylan Michael-Patrick McDonough, 19, of Gladstone, were both scheduled for a dual-jury trial starting Monday. Gallagher was also scheduled for another dual-jury trial involving another codefendant in October.

McDonough pleaded no contest to one count criminal sexual conduct – second degree, a 15-year felony with 25 years registration as a sexual offender.

With his plea, McDonough’s felony information, which is a document containing the official charges against him, will be amended to not include one count of criminal sexual conduct – first degree. McDonough also agreed to provide truthful testimony against Gallagher in any future proceedings.

The prosecution, Assistant Attorney General Brian Kolodziej, also agreed with a sentencing recommendation of one year in Delta County Jail for McDonough. Sarah Henderson, McDonough’s attorney, noted McDonough has the right to withdraw his plea if the court does not follow the recommendation during sentencing.

Gallagher is facing two cases of criminal sexual conduct.

In the case involving McDonough, Gallagher pleaded guilty to criminal sexual conduct – third degree, a 15-year felony and lifetime registration as a sexual offender.

In exchange for his guilty plea, the prosecution will dismiss his charges of criminal sexual conduct – first degree and criminal sexual conduct – second degree.

The charges in the case involving McDonough and Gallagher stem from an incident in June 2017 in Gladstone.

In the other case, Gallagher pleaded guilty to criminal sexual conduct – third degree, a 15-year felony and lifetime registration as a sexual offender.

In exchange for his guilty plea, the prosecution will dismiss the other count of criminal sexual conduct – first degree.

The charges stem from an incident in August 2018 in Masonville Township. Two other teens faced charges from this incident — Tanner James-Arthur Cannon, 17, of Gladstone, and James Michael Greenlund, 19, of Rapid River.

Cannon has already taken a plea agreement, while Greenlund is the only codefendant that has not taken a plea agreement. Greenlund’s trial is still scheduled for October.

There was no sentencing agreement for Gallagher in either of his cases.

During the hearing, Barglind accepted both McDonough’s and Gallagher’s pleas after hearing testimony from the victims in both cases and hearing Gallagher’s statement in regards to the two cases.

Gallagher said he had forcefully sexually penetrated the victims in both cases.

Barglind said she allowed McDonough’s no contest plea because of McDonough’s difficulty remembering the incident, which she said is an appropriate reason for a no contest plea. After hearing the victim’s testimony, Barglind found McDonough guilty.

Gallagher and McDonough are scheduled for sentencing on Sept. 18.
