GLADSTONE -- The Delta County Circuit Court has dismissed all five cases filed by Michael O'Connor against the City of Gladstone.
The five cases generally alleged violations of the Gladstone City Charter. The city filed a motion for summary disposition arguing that O'Connor lacked legal standing to bring the claims.
Following review of the parties' briefs and exhibits and oral argument held Sept. 2, the court granted the city's motion and ordered all five cases dismissed.
In its decision, the court explained that standing requires a litigant to have a special injury, right, or substantial interest that is affected differently from the public at large, unless standing is otherwise provided by statute. The court concluded that O'Connor had not alleged a unique or special injury different from that of other City residents.
"Generally, Plaintiff brought these suits alleging violations of the city charter," the court wrote. "Plaintiff has not alleged any unique or special injury that is different from any other citizen of the City. Therefore, the Court must dismiss all cases."
