Suspect in Green Bay child’s death held on $2M bond

Bond was set at $2 million Monday in Brown County, Wis., Circuit Court for a 21-year-old Green Bay man arrested Friday in Florence County in connection with the death of a 2-year-old boy.

James VanderLeest and his father, 48-year-old David VanderLeest, also of Green Bay, are both expected to be charged in the death, but the Brown County District Attorney’s Office is still working on the final charges, the Green Bay Press-Gazette reported.

The case concerns a 9:15 a.m. call June 22 to the 100 block of Alpine Drive for a 2-year-old boy with serious injuries, according to Green Bay police. The child died two days after being airlifted to Children’s Wisconsin in Milwaukee.

As reported by the Press-Gazette, Brown County Deputy District Attorney Wendy Lemkuil alleges that:

— James and David VanderLeest told investigators David was taking care of the boy at the time when James was actually watching the boy.

— James VanderLeest told the boy’s mom to also tell police that David was watching the boy.

— James VanderLeest told investigators the boy fell down the stairs, but the autopsy and child abuse experts at Children’s Wisconsin said his death was the result of an “acute incident” instantaneously that wasn’t from a fall.

— The VanderLeests tried to flee and hide in a relative’s cabin and ditched their phones until law enforcement found them at the cabin.

— James VanderLeest did not call 911 for the boy and instead called his dad.

During a probable cause hearing Monday, James and David VanderLeest disputed details in the probable cause statement, the Press Gazette said. According to the newspaper, David VanderLeest said he hadn’t tried to flee and didn’t know an arrest warrant had been issued for his son.

lorence County Sheriff Teresa Chrisman said Green Bay Police notified her department just before 6:30 p.m. Friday of a homicide investigation and that a suspect appeared to have gone to a cabin in Long Lake. It was further reported he had two felony warrants.

Friday’s arrest was made with assistance from Marinette County’s Critical Incident Response Team and several other agencies, Chrisman stated in a news release Saturday.

According to WLUK-TV, Lemkuil in court Monday said David and James VanderLeest “stayed in the house barricading themselves and weren’t coming out until they did a flash bomb.”

eest also made an initial appearance Monday for a previous case with two counts of bail jumping, the Press-Gazette said. Bail was set at $2 million for the homicide case and $50,000 for the earlier case.

Lemkuil told the Press-Gazette that David VanderLeest faces possible charges of aiding and harboring a felon, obstructing a criminal investigation and being a party to bail jumping.

There are four open cases in Brown County against James VanderLeest — counts of strangulation and suffocation, disorderly conduct, misdemeanor and felony bail jumping, criminal damage to property and battery as domestic abuse, according to the Press Gazette.

David VanderLeest is a real estate broker and former Republican candidate for state Senate District 30 and Assembly District 90, the newspaper said. His bail was set at $100,000.

Further court appearances are scheduled for July 16 for James VanderLeest and July 17 for David VanderLeest.

WLUK-TV identified the child who died as 2-year-old Leo Escalante. Family of Escalante told WLUK-TV that James VanderLeest is the ex-boyfriend of Escalante’s mother but is not Escalante’s father.

According to court documents, a no-contact order is in place between James VanderLeest and the boy’s mom, the Press-Gazette reported.
