Child porn case sentence is delayed

ESCANABA — What was to be a sentencing hearing for an Escanaba man charged with 14 felonies related to child pornography, instead became an adjournment hearing because of errors found on the pre-sentencing report in Delta County Circuit Court Monday.

John Paul Schiska, 58, appeared via a video conference call from the Delta County Jail and remained silent as his attorney Timothy Cain, Assistant Prosecuting Attorney Lauren Wickman, and 47th Circuit Court Judge John Economopoulos discussed how memos were needed from both sides to address the problems found on the pre-sentencing report. The pre-sentencing report must be accurate for a sentencing hearing.

Michigan State Police arrested Schiska on Feb. 16, 2018, following his release from a medical treatment facility in Marquette. He is charged with 14 felonies that were allegedly committed during a month long period between Jan. 4 and Feb. 6 of 2018 in Delta County.

The charges facing Schiska include three counts of distributing, promoting or financing the distribution of child sexually abusive activity or material, each a seven-year felony carrying a maximum fine of $50,000; four counts of possessing, seeking, or accessing child sexually abusive material, each a four-year felony carrying a maximum fine of $10,000; and seven counts of using a computer to commit a crime with a maximum punishment of four year to less than 10 years, each a seven-year felony carrying a maximum fine of $5,000.

The sentencing hearing is tentatively scheduled for March 1.
