Michigan man gets 35-70 years for 2nd shooting

BATTLE CREEK, Mich. (AP) — A Michigan man has been sentenced to 35-70 years in prison for shooting the same man a second time.

The Battle Creek Enquirer reports (http://bcene.ws/1p1M5lN ) Dawon Haymer was sentenced Friday. He was convicted in July of assault with intent to murder in the shooting of 35-year-old Jonathon Jones.

Haymer requested the judge declare a mistrial because he felt the jury was biased.

Haymer pleaded no contest to assault with great bodily harm less than murder in 2009 after police said he shot Jones. He served six months in prison. Battle Creek police say Haymer shot Jones a second time six months after he was released from prison.

Assistant Calhoun County Prosecutor Rachel Delmont says Haymer deserved a long sentence since he has a history of violence.
