Wisconsin man faces spring trial in CSC case

ESCANABA - A Wisconsin man, accused of sexually assaulting a girl in 2011 in Delta County, will be tried this spring on two counts of first-degree criminal sexual conduct, each a life felony.

Justin Dylan Smith, 28, of Sheboygan, Wis., is scheduled for a three-day jury trial beginning May 22 in Delta County Circuit Court. The defense's decision to go to trial rather than make a plea was decided during a pretrial conference hearing in the judge's chambers on Wednesday.

Smith is charged with two counts of first-degree criminal sexual conduct for engaging in sexual penetration of a victim under the age of 13 years. He allegedly sexually assaulted the girl in Masonville Township in November 2011.

Smith remains lodged in the county jail in lieu of a $50,000 cash bond. He was ordered by the court not to have contact with the victim or any minor.
