ESCANABA - An Escanaba man was sentenced to spend a year in jail in connection with one count of breaking and entering and one count of stalking on Wednesday. The judgments were handed down in Delta County Circuit Court.
Earlier this year, Jeffrey Scott Sundby, 50, of 311 S. 10th St., upper apartment, Escanaba, pleaded guilty to the felony of breaking and entering a building with intent and pleaded guilty to a misdemeanor stalking charge.
The charges stem from a March 17, 2012 incident on the 200 block of North 13th Street in Escanaba.
In exchange for guilty pleas to the above two counts, two additional charges were dismissed: second-degree home invasion and aggravated stalking.
In Sundby's statement to the court on Wednesday, he said, "I'm sorry for what I've done. I know I made a mistake. I won't let it happen again."
Judge Stephen Davis questioned Sundby's sincerity because of the trouble he's been in since 2009, citing incidents of larceny, operating while intoxicated, forgery, uttering and publishing, home invasion, stalking, and violation of a personal protection order. Sundby also was on probation at the time of the March 17 incident.
"You've got all kinds of problems here," Davis told the defendant prior to sentencing. The judge added there's a part of Sundby that "does not seem to get it."
On the breaking and entering count, Davis sentenced Sundby to 12 months in the county jail with credit for three months. On the stalking charge, Sundby was sentenced to 12 months in jail to be served concurrently with the other count with three months credit. He was also ordered to pay $648 in fines and costs.
